Acceptable Use Policy (AUP) for xcPEP SaaS Platform
1. Introduction
This Acceptable Use Policy ("AUP") outlines the terms and conditions governing the use of the xcPEP SaaS platform. It defines acceptable and prohibited behaviors to ensure a secure, reliable, and fair environment for all users.
This AUP applies to all customers and their authorized users accessing and utilizing the xcPEP production environment. Adherence to this policy is a condition of service.
2. Prohibited Uses: Ensuring a Secure and Respectful Environment
To maintain the integrity and security of the xcPEP platform and protect all users, certain activities are strictly prohibited. These prohibitions apply to any use of the service, whether intentional or unintentional.
Unlawful or Harmful Activities
Users are prohibited from using the xcPEP platform for any unlawful, fraudulent, or malicious activities. This includes, but is not limited to, activities that violate any applicable local, state, national, or international law or regulation. Users must not engage in any activity that could harm Advanced Structures India Private Limited, its affiliates, or any third party, including actions that could lead to legal liability.
Security Violations
Any attempt to compromise the security or integrity of the xcPEP platform or any connected network is strictly forbidden. This encompasses, without limitation, unauthorized access to systems or data, probing, scanning, or testing the vulnerability of any system or network, and breaching security or authentication measures. Users must not interfere with or disrupt the service or any associated servers or networks.
System Abuse
Abuse of the system resources or network infrastructure is prohibited. This includes, but is not limited to, transmitting any material that contains viruses, Trojan horses, worms, time bombs, or any other harmful or deleterious programs. Users must not engage in activities that impose an unreasonable or disproportionately large load on the platform's infrastructure, or that could damage, disable, or impair the operation of the service.
Content Restrictions
Users must not upload, post, transmit, or otherwise make available any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. This also includes content that infringes upon the intellectual property rights of others, such as copyrights, trademarks, or trade secrets.
Unauthorized Access or Interference
Accessing or attempting to access any account, data, or system that is not explicitly authorized is prohibited. Users must not interfere with or disrupt the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the service. The use of any robot, spider, or other automated device or process to access or monitor any portion of the service is also prohibited without prior written consent.
3. User Responsibilities: Promoting Fair and Responsible Use
All users are expected to adhere to certain responsibilities to ensure the proper and fair use of the xcPEP platform. These responsibilities are crucial for maintaining a high-quality service for everyone.
Compliance with Policies and Laws
Customers and their authorized users are responsible for ensuring their use of the xcPEP platform complies with this AUP, the Master Service Agreement, and all applicable laws and regulations. Any non-compliance may result in service suspension or termination.
Account Security
Users are responsible for maintaining the confidentiality of their account credentials, including usernames and passwords. Any activity that occurs under a user's account is the sole responsibility of that user. Users must promptly notify Advanced Structures India Private Limited of any unauthorized use of their account or any other breach of security.
Data Integrity and Accuracy
Users are responsible for the accuracy, integrity, and legality of any data or content they upload, store, or process on the xcPEP platform. Advanced Structures India Private Limited is not responsible for the content of user data.
4. Enforcement and Consequences: Addressing Policy Violations
Advanced Structures India Private Limited reserves the right to determine, in its sole discretion, whether a use of the xcPEP platform violates this AUP. Violations may result in various enforcement actions, up to and including immediate termination of service.
Investigation of Violations
Upon becoming aware of any potential violation of this AUP, Advanced Structures India Private Limited may investigate the matter. This may involve gathering information from the user and any affected third parties, as well as examining any data or logs related to the suspected violation.
Corrective Actions
If a violation is confirmed, Advanced Structures India Private Limited may take appropriate corrective actions. These actions may include, but are not limited to, issuing warnings, requiring the removal of prohibited content, temporarily suspending access to the service, or permanently terminating the user's account. The severity of the action will depend on the nature and impact of the violation.
Legal Recourse
Advanced Structures India Private Limited reserves the right to pursue any and all legal remedies available under applicable law for violations of this AUP. This may include reporting unlawful activities to appropriate law enforcement authorities.
5. Reporting Violations: Partnering for a Safer Environment
Users are encouraged to report any suspected violations of this AUP to Advanced Structures India Private Limited. Prompt reporting helps maintain the security and integrity of the platform for all users.
